Terms of Service — 3am.chat

Effective: July 27, 2026

These terms are an agreement between you and us. By using 3am.chat you accept them. If you don't agree with something here, the honest move is not to use the service. We tried to keep this short enough to actually read at 3am.

1. Who we are

3am.chat is operated by 3AM Chat ("we", "us"). It is a free, text-based conversation service: you get matched with another person at random and you talk. No accounts, no public profiles — just text between two strangers who are both awake. A profile picture is optional and is reviewed before it is shown to anyone.

2. Eligibility

You must be at least 18 to use 3am.chat. Before your first conversation, an age gate asks you to confirm you are 18 or older and that you accept these Terms and our Community Guidelines. That confirmation has to be truthful. The service is not for minors — if we find out someone is under 18, we close their session and remove them immediately.

3. Acceptable use

Most of this comes down to one idea: the person on the other end is real, and probably tired. While using the service, you may not engage in:

sexual content or sexual advances of any kind, in messages or in a profile picture;
uploading a picture that isn't yours to upload, shows another identifiable person, or shows a minor;
harassment, threats, or hate speech;
spam, advertising, or solicitation;
attempting to buy or sell anything;
sharing another person's personal information, or collecting information about our users;
impersonating any person or organization;
illegal content or activity of any kind;
attempts to bypass our filters, bans, or moderation.

The Community Guidelines explain these rules in ordinary language. If the two documents ever seem to differ, these Terms control.

4. Moderation and enforcement

We use automated filters (which block links, contact details, and explicit language) together with human moderators who review reports. If you break the rules, we may warn you, end a conversation, restrict features, or ban you — temporarily or permanently. We decide these things at our discretion and without prior notice. We aim to review reports within 24 hours.

5. Your messages

What you write is yours, and you are responsible for it. You grant us a limited right to process and store your messages, solely so we can run the service and moderate it. Chat logs are kept for up to 30 days and then deleted, as described in our Privacy Policy. We don't use your conversations for advertising, and we don't sell them to anyone.

6. The service is provided "as is"

3am.chat is free, and we offer it as it is. We make no promise that it will always be available, uninterrupted, error-free, or fit for any particular purpose. Some nights the servers are as unreliable as the rest of us. To the extent the law allows, we disclaim all warranties, express or implied.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service, or for what other users say to you. Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, and nothing here affects mandatory consumer rights you have under the laws of your country.

8. Changes

We may update these terms from time to time. If you keep using the service after an update takes effect, that counts as acceptance of the new terms. For material changes we will flag the update on the site so you have a fair chance to read it first.

9. Termination

You can stop using 3am.chat at any time — just close the tab; there's no account to delete. We can suspend or end your access if you violate these terms or the Guidelines, as described in section 4.

10. Governing law

These terms are governed by the laws of the place where 3AM Chat is established, unless mandatory law in your country of residence says otherwise — in which case that law applies to the extent it must.
